Terms & Conditions

1. Agreement & Acknowledgement
By submitting any job form, quotation acceptance, or proceeding with payment, the Client acknowledges and agrees to be bound by these Terms & Conditions.

No physical signature is required. Submission of form or payment constitutes full acceptance.

2. Scope of Services
IKEN MARKETING PTE LTD provides marketing and distribution services including but not limited to:

2.1 Distribution Types

  • Door-to-Door HDB Distribution
  • Landed Property Letterbox Distribution
  • Commercial / Retail / Warehouse Letterbox Distribution
  • Street Distribution (Flyers / Promoters / Surveyors)
  • EyeOnMe™ Distribution (Billboard / Standee / Carrying Boards)
  • Car Distribution (Car hanger on door handle / windscreen)
  • SingPost Letterbox Distribution (via third-party provider)

2.2 General Scope

  • Allocation and coordination of manpower
  • Distribution execution within agreed areas / time
  • Photo proof and reporting (where applicable)

3. Collection & Delivery of Flyers

  • All collection and delivery of flyers are chargeable unless otherwise stated.
  • Clients may arrange self-delivery and collection from IKEN office.
  • IKEN may assist in logistics at an additional cost (subject to availability).

4. Payment Terms

4.1 General Rule

  • Payment must be completed BEFORE commencement of any job

4.2 Payment Structure

  • Below $2,000 → Full Payment Required
  • $3,000 – $5,000 → 2 Milestones (must pre-agree amount + dates)
  • Above $8,000 → 3 Milestones OR split invoices

4.3 Credit Terms

  • Only applicable to approved returning customers / partners
  • Standard: 30 Days Credit Terms

4.4 Important

  • No job will commence without budget release / payment confirmation
  • Delays in payment may result in delay or rescheduling of job

4.5 Payment Proof Requirement

  • All payments made must be accompanied by valid proof of payment, such as:
  • Bank transfer screenshot
  • Transaction reference number
  • Payment confirmation slip
  • Payment is considered officially received ONLY after:
  • Proof of payment is submitted to IKEN MARKETING PTE LTD, and
  • Acknowledgement is provided by IKEN MARKETING PTE LTD
  • IKEN MARKETING PTE LTD shall not be responsible for any delay in job commencement or execution due to:
    • Failure to provide payment proof
    • Late submission of payment proof
    • Unverified, pending, or unclear transaction details
    • IKEN MARKETING PTE LTD reserves the right to delay, reschedule, or withhold job execution until:
    • Payment is fully received, and
    • Payment proof is properly verified
    • Clients are strongly advised to ensure that payment proof is submitted immediately after transfer to avoid any disruption to job scheduling and operations.

5. Execution & Operational Conditions

5.1 Distribution Nature

Distribution is carried out on a best-effort basis within the agreed areas and timeframe.

As this is a physical, on-ground activity, actual coverage may be influenced by factors such as:

  • Restricted access (e.g. locked gates, security-controlled areas)
  • Building or estate regulations
  • Weather conditions
  • Human movement and response
  • Environmental and operational constraints
  • IKEN MARKETING PTE LTD will take all reasonable measures to execute the distribution effectively based on the planned scope.

5.2 Timing Flexibility

IKEN reserves the right to:

Adjust timing within reasonable range
Reallocate manpower
Reschedule due to weather, safety, or operational constraints

6. Photo Proof & Reporting

  • Photo proof is provided as supporting evidence of execution, not full audit tracking.
  • Clients must report missing updates promptly during campaign.
  • Lack of feedback during execution implies acceptance of progress.

7. Warranty Period (Dispute Window)

To ensure fair validation:

  • Door-to-Door Distribution → 1 Day after completion
  • Street / EyeOnMe Distribution → 1 Hour after session
  • Other Services → Within 24 Hours

Important

  • Complaints submitted after warranty period will not be entertained
  • Due to the nature of distribution, delayed claims cannot be verified

8. Dispute Resolution & Solution Approach

In case of valid disputes within warranty period:

IKEN will:

  • Investigate internally (photo proof, distributor logs, supervisor reports)
  • Assess validity fairly

Possible resolutions (if justified):

  • Partial re-distribution
  • Service credit adjustment
  • Operational correction

Not Acceptable Claims

  • General statements like “no response” or “no results”
  • Claims without evidence within timeframe
  • Expectations beyond agreed scope

9. No Guarantee of Results

Client acknowledges that:

  • IKEN does NOT guarantee sales, leads, or response rates
  • Marketing outcome depends on:
    • Product-market fit
    • Offer attractiveness
    • Timing
    • External factors

No compensation will be provided for lack of results.

10. Third-Party Services (e.g. SingPost)

  • IKEN may engage third-party providers for fulfillment
  • IKEN responsibility ends upon handover with proof

IKEN is NOT liable for:

  • Delays
  • Loss
  • Damages caused by third-party providers

11. Car Distribution Disclaimer

  • Flyers may be placed on:
    • Car door handles
    • Windscreens (with protective sleeve where applicable)

IKEN MARKETING PTE LTD:

  • Uses reasonable care (e.g. plastic sleeve protection)
  • Shall NOT be liable for any stains, marks, or damages to vehicles

12. Client Responsibilities

Client agrees to:

  • Provide accurate job details and locations
  • Approve artwork before execution
  • Ensure materials are suitable for distribution
  • Deliver materials on time (if self-supplied)

13. Cancellations & Refunds

  • All payments are non-refundable once job is confirmed
  • Cancellation:
    • Before job → May reschedule (subject to availability)
    • On job day → Up to 50% considered consumed
    • After job start → Considered completed (no refund)

14. Limitation of Liability

IKEN MARKETING PTE LTD shall not be liable for:

  • Indirect or consequential losses
  • Business loss, reputation damage, or opportunity loss
  • External complaints (residents, public reactions)

15. Governing Law

This Agreement is governed under the laws of Singapore.

16. Final Clause

This document represents the full agreement between Client and IKEN MARKETING PTE LTD and overrides any prior verbal discussions.
